The Legal Landscape

Same-sex relationships have been legal in Peru since 1924, and anti-discrimination protections on the grounds of sexual orientation and gender identity have been in place since 2017. Same-sex marriage is not currently legally recognized, and there is no civil union framework offering equivalent rights, though parliamentary discussion on the matter has been ongoing for some years.

In 2024, Peru’s health ministry issued a decree that classified transgender identities using an outdated medical framework. The backlash was swift and substantial: more than 60 LGBTQ+ organizations staged protests in Lima, international human rights bodies condemned the decree, and the health ministry walked back its application shortly afterward. In April 2026, Peru’s Supreme Court ruled the original decree unconstitutional, finding it violated trans people’s rights to personal liberty, privacy, and health. The decree has not yet been formally repealed, but the Supreme Court ruling is binding and marks a meaningful legal step forward.

Lima: The Most LGBTQ+-Welcoming City in Peru  

Lima is widely regarded as one of the most LGBTQ+-welcoming cities in South America, and for travellers staying in Miraflores and Barranco, that assessment holds in practice. Both neighborhoods are cosmopolitan, internationally oriented, and thoroughly relaxed about same-sex couples. Booking a double room, dining together, and moving through the city as a couple draws no particular attention in either district.

The city has a well-established LGBTQ+ nightlife scene. DownTown in Miraflores is the best-known gay venue, a classic disco with six distinct rooms and regular drag shows. Lola Bar offers a more relaxed, social atmosphere. Lima Pride, held annually in late June, is the largest in Peru: in 2023, a record 50,000 people marched through the capital.

Outside Miraflores and Barranco, Lima follows the pattern of most large South American cities: central and tourist areas are straightforward for LGBTQ+ visitors, while some peripheral neighborhoods warrant the same general awareness any traveller would exercise. Any risks visitors encounter in Peru are broadly comparable for LGBTQ+ and non-LGBTQ+ travellers alike. Cusco and the Sacred Valley

Cusco is very safe for gay travellers, in large part because it is so internationally oriented, with visitors arriving year-round from across the world. Tourism drives the city’s economy, and that shapes how guests are received. The Supreme Court ruling is significant and binding, but the underlying political environment remains conservative, and Peruvian human rights organizations continue to push for full repeal.

On documentation: legal gender recognition in Peru requires a court process rather than a straightforward administrative one, which makes it procedurally complex. Trans travellers should ensure their travel documents are consistent and carry any relevant supporting paperwork. For medication, Peru has no specific import restrictions on hormone therapies, but we recommend carrying documentation from a prescribing physician and verifying requirements at the time of travel.

In terms of day-to-day experience, Lima and Cusco both have established trans communities and trans-affirming spaces, and the luxury properties we recommend have no issues with trans guests.
