Is Peru Safe for Gay Travelers?

The short answer is yes. Peru is a country where same-sex relationships are legal, anti-discrimination protections exist in law, and the major cities of Lima, Cusco, and the Sacred Valley have a long, well-established track record of welcoming LGBTQ+ visitors. At the luxury level, in the hotels and restaurants where Out Of Office operates, gay and lesbian couples travel comfortably, openly, and well.

Like most destinations outside Western Europe and North America, Peru has its nuances, and we think it’s worth being honest about them. Same-sex marriage is not yet legally recognized. The political direction in recent years has been more conservative than progressive. And Peru’s own LGBTQ+ community has had to fight, publicly and persistently, for rights that visitors from more liberal countries may take for granted. None of this makes Peru a destination to avoid. It makes it one to approach with clear information and the right travel partner behind you.

 

 

Same-sex relationships have been legal in Peru since 1924, and anti-discrimination protections on the grounds of sexual orientation and gender identity have been in place since 2017. Same-sex marriage is not currently legally recognized, and there is no civil union framework offering equivalent rights, though parliamentary discussion on the matter has been ongoing for some years.

In 2024, Peru’s health ministry issued a decree that classified transgender identities using an outdated medical framework. The backlash was swift and substantial: more than 60 LGBTQ+ organizations staged protests in Lima, international human rights bodies condemned the decree, and the health ministry walked back its application shortly afterward. In April 2026, Peru’s Supreme Court ruled the original decree unconstitutional, finding it violated trans people’s rights to personal liberty, privacy, and health. The decree has not yet been formally repealed, but the Supreme Court ruling is binding and marks a meaningful legal step forward.

For gay and lesbian travelers, the practical legal situation is stable and well-established. For trans travelers, the picture requires more specific planning, and we cover that separately below.

Lima: The Most LGBTQ+-Welcoming City in Peru  

Lima is widely regarded as one of the most LGBTQ+-welcoming cities in South America, and for travelers staying in Miraflores and Barranco, that assessment holds in practice. Both neighborhoods are cosmopolitan, internationally oriented, and thoroughly relaxed about same-sex couples. Booking a double room, dining together, and moving through the city as a couple draws no particular attention in either district.

The city has a well-established LGBTQ+ nightlife scene. DownTown in Miraflores is the best-known gay venue, a classic disco with six distinct rooms and regular drag shows. Lola Bar offers a more relaxed, social atmosphere. Lima Pride, held annually in late June, is the largest in Peru: in 2023, a record 50,000 people marched through the capital.

Outside Miraflores and Barranco, Lima follows the pattern of most large South American cities: central and tourist areas are straightforward for LGBTQ+ visitors, while some peripheral neighborhoods warrant the same general awareness any traveler would exercise. Any risks visitors encounter in Peru are broadly comparable for LGBTQ+ and non-LGBTQ+ travelers alike. Use official or app-based transfers, keep valuables secure, and take your hotel concierge’s advice on where to go.

Cusco and the Sacred Valley

Cusco is very safe for gay travelers, in large part because it is so internationally oriented, with visitors arriving year-round from across the world. Tourism drives the city’s economy, and that shapes how guests are received. The city’s gay scene is intimate rather than prominent. Cusco is not a nightlife destination. It is a small, beautiful city where travelers come for its extraordinary cultural heritage and mountain landscapes. Some bars in the historic center are LGBTQ+-welcoming, but most couples visiting for Machu Picchu and the Sacred Valley find their experience shaped far more by the hotels and private guides they travel with than by any specific scene.

In more rural parts of the Sacred Valley, public attitudes are more traditional, and Catholic teachings hold considerable influence. In smaller villages and rural areas, the same awareness around public displays of affection that applies in many destinations is worth bearing in mind. At the luxury travel level, where itineraries are built around private vehicles, vetted guides, and carefully selected properties, this is rarely a practical concern.

Practical Advice for LGBTQ+ Travelers

Booking a double room, arriving as a couple, and being open about your relationship is entirely standard practice at these properties. In Lima’s Miraflores and Barranco districts, and in Cusco’s tourist center, same-sex couples attract little attention. In rural areas and smaller towns, a degree of cultural awareness around public displays of affection is sensible, as it would be in many parts of the world.

Trans travelers to Peru benefit from more specific planning than gay or lesbian visitors, and that remains true even in light of the positive legal developments of recent months.

The 2024 health ministry decree, though walked back in its application and ruled unconstitutional by the Supreme Court in April 2026, has not been formally repealed by the executive government. The Supreme Court ruling is significant and binding, but the underlying political environment remains conservative, and Peruvian human rights organizations continue to push for full repeal.

On documentation: legal gender recognition in Peru requires a court process rather than a straightforward administrative one, which makes it procedurally complex. Trans travelers should ensure their travel documents are consistent and carry any relevant supporting paperwork. For medication, Peru has no specific import restrictions on hormone therapies, but we recommend carrying documentation from a prescribing physician and verifying requirements at the time of travel.

In terms of day-to-day experience, Lima and Cusco both have established trans communities and trans-affirming spaces, and the luxury properties we recommend have no issues with trans guests. The picture in rural areas and smaller towns is less predictable; we strongly encourage trans travelers to speak with our team before booking, so we can advise on specifics based on your itinerary and current conditions on the ground.

Peru has a strong and active LGBTQ+ rights movement. Organizations including PROMSEX, Más Igualdad Perú, and the Coordinación Nacional LGTBIQ+ have been central to pushing back against government measures that restrict community rights, and they maintain current information on the legal and social landscape. For travelers who want to connect with the local community or stay informed on developments, these organizations are the right starting point.

The Honest Summary

Peru is a rewarding destination for LGBTQ+ travelers who arrive with the right information and the right arrangements in place. Lima and Cusco, at the luxury level, are as comfortable as most European capital cities for gay and lesbian couples. The legal landscape is imperfect, and the political direction is worth watching, but neither is a reason to write Peru off. The country offers one of the most extraordinary travel propositions in the world, and its LGBTQ+ community, resilient, well-organized, and very much present, is part of what makes it worth visiting.

Trans travelers should plan with more care and speak with a specialist before booking. The Supreme Court ruling of April 2026 is a genuine and meaningful step forward, but the legal environment is still in flux.
