The Law vs. Reality: Gay Travel to the Maldives

There's a disparity between the reality of the Maldives and the country's Islamic law

A holiday to the Maldives is certainly something at the top of many people’s bucket lists. Not only does it offer some of the most beautiful resorts on the planet but the people are friendly, the atmosphere laid back and the drinks aplenty. It also boasts some of the bluest, clearest waters on all of the planet. For many luxury travellers, the Maldives has to be seen at least once in a lifetime.

For LGBTQ+ travellers, though, there is an obvious contradiction. Consensual same-sex sexual activity remains illegal under Maldivian law, with penalties of up to eight years in prison and, under Sharia law, the possibility of 100 lashes. Same-sex marriage is also illegal.

Yet the Maldives has also built one of the world’s biggest luxury tourism industries around private resort islands catering almost entirely to international visitors. Alcohol offers a useful comparison. You cannot legally bring it into the country, and possessing or drinking it outside resort islands can lead to arrest, yet it is freely available at licensed resorts.

And that is really the point of this article. Life on a private resort island can feel very different from life in Malé or on an inhabited local island. The law does not disappear when you arrive at your hotel, but the day-to-day experience for an LGBTQ+ couple staying at a luxury resort is generally very different from what the legal framework might suggest. For example, holding hands as a gay couple on arrival at the airport is not something we would recommend. Greater discretion is sensible in Malé and on inhabited islands, where local customs are considerably more conservative than on the resort islands. Once at a private resort, the atmosphere is generally much more relaxed and international, although Maldivian law still applies throughout the country.
