Thailand has a long reputation as a welcoming destination for gay travelers, and the law now backs it up in one important respect. Same-sex marriage became legal on January 23, 2025, which made Thailand the first country in Southeast Asia to recognize it.

The short answer is yes, with limits worth knowing before you book. Marriage equality has been law since January 2025, and same-sex activity has been legal since 1956. Legal gender recognition is still missing, and everyday attitudes remain more conservative than the country’s image suggests.

What Thai Law Says About Same-Sex Couples

Same-sex sexual activity has been legal in Thailand since 1956. The Marriage Equality Act took effect on January 23, 2025, and any couple aged 18 or over can marry, whether they are Thai or another nationality. A foreign couple is therefore eligible to marry in Thailand.

Rights are not identical for every couple. Thai nationals receive the same legal rights as married heterosexual couples, including joint management of assets, tax benefits, inheritance, and health care. For foreign nationals, rights depend on immigration status, and marrying a Thai national does not yet lead to Thai citizenship.

Family law has not caught up. Thai law still defines parents as a mother and a father, and experts have raised concerns about how officials will interpret adoption rules for same-sex couples.

Bangkok

Bangkok is the main international gateway for most Thailand itineraries, and it is where the marriage law first became visible. Couples registered their marriages at an event at the Paragon shopping mall on January 23, 2025, the day the law took effect. The city also hosts an annual Pride parade, attracting crowds from around the world.

The gay bars and clubs are concentrated in Silom, around Soi 2 and Soi 4. Bangkok pairs well with a beach stay in Phuket or Koh Samui, so the trip moves from city nightlife to resort time.

Phuket

Phuket’s gay nightlife is centered on Patong, where bars and cabaret venues sit close together. The resorts that suit couples are located elsewhere on the island, so a trip can pair a quiet base with an evening out in Patong when the mood calls for it.

Trans and Nonbinary Travelers

The legal position for trans and nonbinary people is weaker than the marriage law suggests. Parliament rejected a gender recognition bill in February 2024, and Thai citizen ID cards still use binary gender prefixes based on gender assigned at birth. Draft bills remain under discussion, and activists have said they will keep pushing for one to pass.

Gender-affirming care is legal in Thailand. These document rules apply to Thai citizens, so the practical point for a visitor is the usual one, that names and gender markers on bookings should match the passport.
